Hallo liebe Business- und Steuerexperten im Forum (und liebe Kleinunternehmer, die vielleicht in einer ähnlichen Situation waren und schon schlauer sind als ich), Ich bin echt am Verzweifeln - und weder die Auskünfte vom Steuerberater, HMRC und dt. Finanzamt konnten meine Frage 100%ig zufriedenstellend beantworten (jeder konnte lediglich über seinen Teilbereich Auskunft geben, aber mir fehlt "das große Ganze")   Die Situation: - selbständig als sole trader in UK (UK resident) - Beratung & Services im Bereich Marketing, Kommunikation, HR, Eventmanagement, Organisation - non-VAT registered (!)   Problem und Lösungsansätze: Ich möchte meine Dienstleistungen nun einem Geschäftskunden mit Sitz in Deutschland erbringen. Der Kunde ist ein Unternehmen und in Deutschland umsatzsteuerpflichtig registriert. Die Erbringung der Dienstleistung erfolgt in UK (an meinem Laptop), ich muss also nicht nach Deutschland reisen. Preisfrage: Was muss ich nun bei der Rechnungsstellung beachten, damit sie von meinem deutschen Kunden anerkannt werden kann?!   Laut britischen Steuerberater und HMRC ist die Sache ganz einfach: Als Kleinunternehmer darf ich keine VAT ausweisen, weder in UK noch in der EU. Es reicht, eine einfache Rechnung zu erstellen mit dem Hinweis "not VAT-registered in UK" und das war's. Easy. Und ich weiß, dass dies bei Dienstleistungen in andere EU-Länder (z.B. Niederlande) auch der Fall ist. Also wollen mir nun die deutschen Behörden mein Business verkomplizieren, oder gelten für Deutschland tatsächlich Zusatzbestimmungen?   Denn das deutsche Finanzamt sagte mir auf Anfrage, ich würde zwingend eine Umsatzsteueridentnummer (9-stellige Nummer, beginnend mit GB) benötigen, andernfalls würde in Deutschland kein Unternehmen eine solche Rechnung akzeptieren. Es reicht angeblich nicht, nur die Tax Reference Number (UTR), die ich auch als non-VAT registered sole trader vom HMRC bekomme, anzugeben.  HMRC wiederum vergibt - logischerweise - eine solche GB-Umsatzsteueridentnummer nur an VAT registered businesses, ich sehe also aktuell keine Chance als non-registered sole trader, die Anforderungen seitens Deutschland an eine ordnungsgemäße Rechnung zu erfüllen, oder?!? Bzw. kann ich eine ordnungsgemäße Rechnung erstellen, die vom Kunden (formal) akzeptiert werden muss, ohne GB-Umsatzsteueridentnummer?   Lange Rede, kurzer Sinn: Habe ich es richtig verstanden, dass ich als non-VAT registered sole trader keine Dienstleistungen an ein deutsches Unternehmen erbringen DARF?!? (anders formuliert: wer mit deutschen Unternehmen Geschäfte machen will, MUSS VAT-registered sein?!)   Ehrlich, ich bin echt frustriert. Es ist ein kleines Beratungs- und Dienstleistungsgeschäft, nix großes (daher auch sole trader und nicht Limited und auch keine VAT-Registrierung), aber ich habe das Gefühl, mir werden hier unnötig Steine in den Weg gelegt...   Deshalb 1000 Dank an alle, die mir hier qualifiziert weiterhelfen und zur Problemlösung weiterhelfen können (hier im Forum oder als PM).
